There's been too much ruckus in the media and social networks, about whether or not, Yakub Memon, the lone arrested convict, sentenced to hang, should be awarded the sentence. I'm compelled not to stay away from this argument, and to pour out my part of knee-jerk reaction, amidst the rest.
My points add below:
1. There was a ghastly bomb blast in 1993, in Bombay.
2. The main perpetrators were identified as Dawood Ibrahim, Tiger Memon, and his brother Yakub Memon.
3. Whilst the former two have found safe haven in Pakistan, the younger Memon was apprehended and prosecuted, which resulted in death sentence.
4. There's been 22 years, and we're still dilemma-ttic, if he should really be hanged, and on the day before his scheduled sentence administration, there are sections of the society, seeing the 'ray of hope'.
5. There're arguments and demands, for both to uphold the sentence, and to commute it, as well.
6. The judicial offices have been put too much of usage in the last one week, and now, the Chief Justice of India, has agreed to allow a review in the rejection of his mercy petition, at 2.AM, an unprecedented move, much appearing to be to convince the dramatic petitioners.
7. As far as I've learnt, a proceeding in the judicial hall, begins with the district magistrate's court, levels up to the sessions court, then to High Court, and finally to Supreme Court, and whatever Supreme Court says, had to be the end of it.
8. For capital sentences alone, the convict has an additional resort of clemency petition, to be accepted or rejected by the president.
This, though, is not my matter of contention in this article, by far, has been a format of monarchical disbursement of penal justice, practiced by the rulers of various states, including the British monarchs. Now, this job of the king or queen, has been granted to the President, often accorded as the First Citizen of the country. This, in all by itself, ridicules the judicial system, and hands over, an override button to stop the noose from gripping around, despite the volumes and person hours of arguments placed in the courts, and the merits weighed in condemning someone unfit to exist in a civilized society.
9. In this case of Mr Memon, the clemency option has also been unfavorable to him.
10. However, the legal fraternity has been up in its entirety, to see a way out for the younger brother of a noted terrorist, which is by far, beyond the framework of the legal apparatus. There are much more important cases that can be handled. But, that would be devoid of publicity.
11. The arguments placed by various groups standing for and against the execution, are both laughable and condemnable.

If that's the case, this blast killed and had the potential to kill people of all religions, believes, cast, creed, strata, or whatever. And moreover, there's either no or a zillion modifications to a crime.
The demolition was a crime. But, that can again be attributed to invasion.
> Salman Khan asks, why are you hanging the younger brother for elder one? In 140 characters, it may be the most reasonable argument ever. But, I'm confident, the judicial proceedings of this one case would have amounted all the 140 characters in the world. I've not gone through that. But, if the defense lawyer had not asked it, I really pity Yakub, his elder brother with all his connections, couldn't help a good lawyer to this chotu.
> And there are columnists and religion's voices, who cite security concerns, if he's hanged. Not a fair argument. A state cannot be taken for a random.
> There are actresses, who wanted to "hang the b...". They're exercising their 'FoE'. And, they're dated, and finding or trying to find some limelight, through one thing or the other. Good luck with their new bait.
> And, there I fainted, when someone asked in social media, for his castration, before hanging. The person is a right wing aficionado. Supporter of the current government. The party in rule believes in Lord Rama. Let's know, if Lord Rama would feel happy and proud about such a thought.
12. There are a number of changes required, firstly, in us, Indians. We cannot mature of we continue to be fathered by the emotional melodrama. We must agree to the rule of law. If the law is insufficient, let's rewrite it.
13. Media can't become judiciary. We're made to believe, a few channels, with a viewer rate of a very few hundreds of thousands, in a billion living nation, pretends to know everything. One can't be fooled with that. NDTV and TV18 networks have reported losses and falling earnings consecutively, and pretends to be the channel the people respect to watch. One anchor cries out of his belly, "the nation wants to know". Let someone tell him, if he believes a few hundreds of thousands make a nation to him, he perhaps is dreaming himself to be in countries like Luxembourg or Mauritius.
14. Judiciary has to come out clean, candid and transparent. When Mr Owaisi claims that, Memon is hanged because of his religion, the same day when the apex court upheld his sentence, it also agreed to commute the capital sentences to life, for the killers of our former Prime Minister.
I'm not saying, what Owaisi said is true. But, you're offering him a brownie point here. There are so many cases that are adjourned in a day. The latter case could very well have been one. The judges' hearing the case have the discretion.
I'm not for or against the capital sentence served here. But, let's mature to a level, where we all uphold the rule of law, consider it worth doing, because, it's really worth doing, in the long-standing.
